Nursing Home Neglect
Some of us who make the decision to place our loved one in a nursing home do so because we may live outside New York City, and the elderly person cannot live alone. You trust that the nursing home you have carefully chosen is doing as good a job as any in-home nurse would do. However, there are many situations of New York City nursing home neglect that can be harmful for the patient. The New York City injury lawyers of Jacob Fuchsberg Law outline the types of nursing home negligence, and the legal steps you should take.
Types of Nursing Home Neglect
To accuse a nursing home of neglect, you must have proof of the neglect.
- If it’s physical neglect, do you see scars, scratches or welts on the elder? Does the elder cringe when you come close, or act intimidated or afraid?
- If you suspect psychological neglect of the elder, do you notice the patient acting withdrawn or depressed, and unable or unwilling to communicate? They could be getting threatened, yelled at, manipulated, or coerced into complying with something they feel is wrong.
- Is the nursing home negligent in the running of their facility? Is the New York City nursing home clean and the equipment fully operational?
Your First Steps in Taking Legal Action in Nursing Home Neglect
Your first reaction to nursing home neglect may be anger. However, you need to be calm and communicate the facts to us so we can build a case:
- How was the nursing home patient neglected?
- What did you observe from the patient? Was it physical marks, or the after-effects of psychological abuse such as depression and an unwillingness to communicate?
- If the nursing home equipment was not functioning properly, what occurred?
- Write down the date, time, location and any other information you have about the incident. Include the amounts of occurrences if it happened more than once.
- Do you have any other proof besides what you have observed? Do you have any photos or records? Any witnesses?
- Did you contact a nurse, nursing administrator, doctor, or a member of the administrative staff? Did they do anything or investigate it themselves?

“While I can't change the course of what's occurred, I can certainly assist, hopefully, in providing people with the ability to care for themselves financially or to somehow get some recompense for the ills caused by other people.”—Leslie Debra Kelmachter
