Ilana Wolk appointed to Exactech Polyethylene Orthopedic Products Liability Litigation

The Jacob Fuchsberg Law firm is pleased to announce that Attorney Ilana Wolk has been appointed to the leadership science committee in the multi-district Exactech Knee, Hip, and Ankle Products Liability Litigation in Exactech Polyethylene Orthopedic Products.

In February of 2022, Exactech issued a recall of all polyethylene tibial inserts manufactured in 2004 or later due to defective vacuum bag packaging that caused premature oxidation. Oxidation severely degrades the mechanical properties of the insert, leading to accelerated wear debris production, bone loss, component fatigue, cracking, fracture, and increased need for revision surgery. As a result, recipients of the faulty implants are more likely to experience pain, swelling, or difficulty moving the joint leading to bone loss.

The recall impacted over 140,000 implants, thus in October the U.S. Judicial Panel on Multidistrict Litigation centralized all Exactech lawsuits into a multidistrict litigation to accommodate for the significant number of cases.

On December 12, U.S. District Judge Nicholas Garafuis in the Eastern District of New York issued a leadership plan and appointed 27 experienced Exactech recall lawyers including our own Ilana Wolk, to serve in various positions and aid with the multidistrict litigation.
