Jaehyun Oh obtained a substantial $7,000,000.00 settlement on behalf of a young man who sustained gruesome third-degree burns after a tank at a decommissioned gas station exploded while he was excavating the tank. Our client was ordered to remove an underground gas tank using an angle grinder, which is a handheld power tool used cutting thick metals. However, angle grinders are particularly dangerous because they emit sparks during use which can cause a fire if they are used in an area that has not been properly inspected for flammable material.

Upon arrival, our client noticed that the gas tank could not be opened and tested for flammable vapors because the cover was rusted shut, which was in violation of Occupational Safety and Health Administration (OSHA) standards. However, even though the tank was not properly inspected to rule-out the presence of flammable vapors or materials, our client was recklessly instructed to cut the tank open using an angle grinder in order to timely complete the project.

Jaehyun Oh alleged that in addition to being instructed to complete an already dangerous activity, defendants added “additional risks by failing to maintain safety or to give proper warning about remaining gas vapors.”

Unfortunately, while our client was performing the excavation, the gas tank ignited causing our client’s entire body to be lit on fire. As a result of the explosion, our client sustained severe disfiguring burns on over half of his body and was hospitalized for over two months. Unfortunately, during the course of our client’s hospitalization, he suffered multiple life-threatening complications, and even after he was discharged, he suffered from severe physical impairments that significantly inhibited his day-to-day life.
