How Can Trusted New York Mass Tort Lawyers Help with Your Case?
When a large global corporation values profits over the safety of its customers, terrible things can happen. Flawed products may be released, and people's lives can be changed forever because of an illness or injury they suffer — even when they're from using the product exactly as intended. A New York mass tort attorney takes on the most egregiously negligent companies and holds them accountable, fighting for victims' justice.
Some of the top mass tort firms accept dozens or even hundreds of clients who have all been harmed by the same company in the same way. These mass torts attorneys go to bat for all these plaintiffs simultaneously and seek compensatory damages for each one — covering medical care, pain and suffering, and other losses.
At Jacob D. Fuchsberg Law, we focus on hitting these reckless companies where it hurts: their bottom line. Our best tort lawyers have decades of combined experience litigating personal injury cases and comprehensive resources to help you navigate the mass tort process of fighting a multinational corporation.
We'll review your circumstances and determine your eligibility for one of our ongoing mass torts lawsuits.
What Do You Need to Know About Mass Torts?
Our clients often ask, “What is a mass tort claim?”. The answer is that it’s a civil action similar to a class-action lawsuit — but not quite the same. Both are civil legal processes involving large numbers of people who have been harmed, but there are a few key differences.
First of all, class action lawsuits are filed on behalf of a “class” of victims called plaintiffs. Each class (there may be more than one class of plaintiffs in a class action lawsuit) has suffered similar injuries due to the same cause. Instead of each plaintiff filing an individual lawsuit, they are gathered together into one class action against the defendant (the party that caused the harm). If the case settles or wins at trial, the class plaintiffs split the award.
On the other hand, mass torts don’t group plaintiffs together but instead have an avenue for each plaintiff to pursue their individual case. These cases are consolidated into one federal legal action, litigated in federal court, referred to as multidistrict litigation (or MDL), and overseen by one judge. The judge becomes very familiar with the pertinent matters of the case and the arguments of both sides.
MDL plaintiffs can pool resources, and their respective lawyers often collaborate on strategy. However, each case is concluded separately, and each plaintiff will have an individual result and award. Even if one plaintiff loses, another could still win. This is unlike a class action, which is all-or-nothing.
Mass Tort Cases We Handle
Dangerous Drugs
The FDA extensively regulates new drugs introduced to the market, but despite this oversight, dangerous drugs are released to consumers every year. Sometimes, the long-term side effects of a medication aren’t discovered for years. Other times, drug manufacturers deliberately hide testing results or studies indicating problems.
Elmiron
Is prescribed to treat interstitial cystitis, mostly in women. Plaintiffs alleged that side effects of the drug caused vision deterioration, including permanent loss of sight.
Toxic Baby Formula (NEC)
Infant formula manufacturing giants Similac and Enfamil are alleged to have released formula contaminated with toxic cow’s milk, which caused necrotizing enterocolitis (NEC) in newborns.

Defective Medical Devices
Some durable medical device manufacturers may have taken advantage of some loopholes in the FDA approval process, releasing unproven and even untested medical devices to the consumer market. Some of these devices are intended to be implanted in a patient’s body, who is left ignorant of the risks posed.
A transvaginal mesh
Treats pelvic organ prolapse (POP) and stress bladder leakage in women. But it can cause bleeding, pain, organ perforation, and infection due to design and manufacturing defects.
Philips CPAP, BiPAP, & ventilator devices
CPAP machines help sleep apnea patients breathe through a tube. Philips ventilator devices are alleged to contain toxic foam, which causes cancer if inhaled.
Exactech
Is a hip and knee implant liner with flawed vacuum sealing. Patients who underwent a knee or hip reconstruction using Exactech devices required surgical revision of the damage.
Several talcum body powder manufacturers allegedly released powder contaminated with asbestos. The powder is applied to the upper thighs and lower abdomen, and when used as directed, the powder may cause cervical and ovarian cancer in women.
Trichloroethylene (TCE) is used as a degreaser for metal parts, but it's known to cause liver damage, heart problems, internal bleeding, and several kinds of cancer. Some people exposed to TCE while working for large oil companies may have suffered lethal exposure levels.
Roundup is a popular weed killer used in residential and commercial landscaping. Users applied Roundup on their lawns to kill weeds and were exposed to toxic chemicals, which caused Non-Hodgkin's lymphoma (a form of leukemia).
Camp Lejeune
Residents — including service members and families — at the Marine base Camp Lejeune may have been exposed to toxic chemicals in the water and soil over 30 years, from the mid-1950s to 1986, when the contamination was finally discovered.
