What Do You Need to Know About Mass Torts?

Our clients often ask, “What is a mass tort claim?”. The answer is that it’s a civil action similar to a class-action lawsuit — but not quite the same. Both are civil legal processes involving large numbers of people who have been harmed, but there are a few key differences.

First of all, class action lawsuits are filed on behalf of a “class” of victims called plaintiffs. Each class (there may be more than one class of plaintiffs in a class action lawsuit) has suffered similar injuries due to the same cause. Instead of each plaintiff filing an individual lawsuit, they are gathered together into one class action against the defendant (the party that caused the harm). If the case settles or wins at trial, the class plaintiffs split the award.

On the other hand, mass torts don’t group plaintiffs together but instead have an avenue for each plaintiff to pursue their individual case. These cases are consolidated into one federal legal action, litigated in federal court, referred to as multidistrict litigation (or MDL), and overseen by one judge. The judge becomes very familiar with the pertinent matters of the case and the arguments of both sides.

MDL plaintiffs can pool resources, and their respective lawyers often collaborate on strategy. However, each case is concluded separately, and each plaintiff will have an individual result and award. Even if one plaintiff loses, another could still win. This is unlike a class action, which is all-or-nothing.

Several talcum body powder manufacturers allegedly released powder contaminated with asbestos. The powder is applied to the upper thighs and lower abdomen, and when used as directed, the powder may cause cervical and ovarian cancer in women.

Trichloroethylene (TCE) is used as a degreaser for metal parts, but it's known to cause liver damage, heart problems, internal bleeding, and several kinds of cancer. Some people exposed to TCE while working for large oil companies may have suffered lethal exposure levels.

Roundup is a popular weed killer used in residential and commercial landscaping. Users applied Roundup on their lawns to kill weeds and were exposed to toxic chemicals, which caused Non-Hodgkin's lymphoma (a form of leukemia).

Camp Lejeune
